“The information we received yesterday from the council certainly made it appear to us that the developer were breaching planning regulations.
But from information received today, it transpires that the perimeter fence is in fact permissible under Class 14 of the General Permitted Development (Scotland) Order 1992 (as amended). This allows for the erection of temporary buildings etc. in relation to development which benefits from planning permission
However, there must be no other work done until all the conditions required prior to phase 1 starting are met, of which there are many.
But please be assured that this work commencing does not in any way deter us from our mission to stop this development - our QCs are currently reviewing our case and we are awaiting further information from them.
