    Kinloch v Corals and 250 grand at stake

    Yet, Ladbrokes owned Corals counsel refuses to use the words "Liquidation" or "Liquidated" in their defence of saying Rangers werent relegated. Suppose its more important to keep your customers and not upset the SPFL as official sponsors, rather than actually use the only weapon that would win the case.

    Rangers FC, the football club, still existed up to the end of July 2012 so not possible for them to have been relegated in May as they were still members of the SPL at that point. It was only when the SPL share was transferred to Dundee and SFA membership withdrawn that they ceased to exist as such. Whatever happened with Sevco applying to join the SFL as a new (senior) club is irrelevant. Still, the court may say Corals have said differently in the past so have to pay.

    One question, among many, that I have never had an answer to is when, if they say they were relegated, at what meeting of the SPL/SFA this occurred, date, time and place. Its easy to see when other clubs were relegated or demoted, i.e.

    Gretna, SFL AGM dated 30 May 2008
    Livingston, Scottish Football League Management Committee meeting dated 5 August 2009

    A search for a similar meeting that proves Rangers were demoted or relegated has not borne fruit, although there are plenty to say they were not being allowed to be fast tracked into the SPFL Premiership on 13 July 2012. Surely if they were relegated, they wouldnt be applying to the Premiership and evidence of them being relegated would be available somewhere ?

    That would be because they were never relegated.
    Any meetings that were held, were held to vote on whether this brand new club should be allowed to begin its journey in Scottish football in the top tier.
    Unsurprisingly, this utterly ludicrous, and frankly laughable, suggestion was booted out...

    It was entirely feasible for someone to buy Rangers PLC in July 2012, pay the debts, and carry on as before, in the SPL. If that had happened, how many Rangers fans would give their loyalty to Charles Green and his plans to create a club. In fact, Sir Walloper's goto guy, mad Gio De Stefano, proposed that very thing. And he's a lawyer

    "Next witness for Coral is Rod McKenzie"

    "McKenzie is a senior partner at Harper MacLoud and helped set up Scottish Premier League limited the court is told"

    "McKenzie says he was the solicitor for the Scottish Premier league and advised them over the "administration and liquidation of Rangers FC"

    "McKenzie says despite rule changes it would have been clear who would be relegated, only on one occasion did the SPL choose"

    "with one exception relegation was decided on sporting performance." McKenzie says. Exception was Falkirk seeking promotion."

    ""Was the football team called Rangers FC ever relegated from the SPL?" McKenzie declines to answer as would involve, him making a judgement on meaning of the word "relegation'"

    BUT THEN !!!

    "McKenzie agrees Rangers had "become ineligible" to play in the SPL as opposed to being relegated."

    "McKenzie declines to reveal whole 5 way agreement as much of it is "confidential" "

    "The 5 way agreement reflected the contractual reality" McKenzie testified

    Well thats that, all testimony in, Corals lawyer might just have sneaked it for them by having a witness admit Rangers liquidated, might be enough for the Judge to sway their opinion that the legal entity that was old Rangers, was not relegated, demoted or thrown out of anywhere, but just basically ceased to exist after July 2012 and couldnt fulfill any promise to start the new season.

    Be good to have a definitive verdict stating Rangers died, it did not teleport itself to Sevco 5088 then magically reappear as Sevco Scotland Ltd before being given a new identity as Rangers International Football Club, gets confusing

    They are struggling like hell to define what relegation means because they really dont want to use Liquidation as a form of exiting a league outwith relegation. Corals/Ladbrokes cant upset their punters by suggesting Rangers werent relegated so they have defended their position by totally avoiding their greatest weapon to sink the case.
