In my experience for every ‘difficult to get rid of’ employee manipulating employment protection legislation for a their own ends there is a ‘wrong ‘un’ Manager who thinks he/she can fire somebody because the employee’s face doesn’t fit or the manager’s advances have been thwarted. This legislation is basically there for the right reason. A surprisingly large number of people seem to think they are above it.

Real problem employees tend to have a record of being problems and better recruitment practices, with some minimum background checking and more thorough interviewing, can reduce the risk of them being hired in the first place.

On the original post, CAM’s experience is a sign of the times we live in. I think it will settle down. I’d rather this than the old days when homo***uality was illegal and gay people were marginalized and vilified at work.

I agree with your last comment CT, back in the Plessey days it was rumoured that Michael Clark CBE (one of the brothers at the top of the company) used to question your ***uality if you wore brown shoes

As for your 2nd paragraph. My wife is currently going through workplace hell because of a 'mistake' her organization made. Maybe I'll share the gory details via email?

There is an amazing stat that says a large amount of people are at least 1 grade higher at work that they're capable of.

In France it is so difficult to make someone redundant that they find it cheaper to promote them to another department to get rid of them.

No names mentioned but a woman at my works attended work when she felt like it. Seen out shopping when she was calling in ill etc. her ailments went on for over a full year. when facing dismissal she'd once again attend work and after a month or so she'd go off again citing something else was wrong with her.

Anyway, they finally dismissed her for failing to fulfil her contractual obligations. She had the balls to appeal and thankfully it was upheld.
Over a year she just messed the company about and it took meeting after meeting to keep on the right side of the PC employment brigade. In a nutshell she was just a damn lazy cow and good riddance!
Good people should be rewarded and looked after.
It’s people who take the piss who spoil it for everyone else.
We’ve just eventually got someone off our books who said she was sick and was on Facebook out clubbing weekends away etc.
She never attended meetings just claimed she was ill.
I have now used part of her salary to give 4 genuinely hard working people a pay rise just how it should be.

I don't know if it's a stat Frog but there is a management concept called the "Peter Principle" which states that :

"people in a hierarchy tend to rise to their "level of incompetence". Basically employees keep getting promoted until they can't be promoted again. The skills they had in their previous position are different to the next job up and they are not suited for it.
It was meant to be a satirical book but it does seem to have a logic to it.
