Thread: Refugees or Illegal immigrants..?

  1. #81
I can't answer that C_M, I am more interested in your response: Under maritime law on receipt of a distress call Masters of a vessel are required to 'Provide Assistance subject to not putting their own vessel or crew in danger'. Providing assistance does include contacting the shore authorities and reporting the incident and position of the distressed vessel if they feel that they cannot provide adequate assistance themselves.

Under the 1982 United Nations Convention of the Law of the Sea, ships have a clear duty to assist those in distress. Article 98 (1) states that “ Every State shall require the Master of a ship flying its flag, in so far as he can do so without serious damage to the ship, the crew, or the passengers…

Every vessel at sea operates under a 'Flag of Jurisdiction'. The vessels that I currently look after come under 'Cayman islands, Bermuda and UK Flag. My own yacht is registered under the Uk flag with the Port of registry as London. If I was on my little 25 meter Sunseeker in the Med and came across a boat full of refugees/Asylum Seekers I would evaluate the consequences of embarking them. Taking in to account the stability of my own yacht, safety of my crew and number of refugees. I would also look at the composition of the refugees meaning I would think twice before embarking 10 fighting age males.

It is most likely that I would stand off and radio the shore authorities.

Professional response is that C_M, your obvious RN training and experience is well to the fore.

I have to agree and it meets all requirements as laid down in the Law of the Sea.
BT ---you never, ever forget your service training because you have to adhere to Queen's Regulations otherwise you lay yourself open to lots of things.
I do realise that you would struggle to stick to regulations laid down by someone who you hate so much, however, for us that have served ----c'etait la vie!

Just been doing a bit of research on this BT, that five star business is FAKE NEWS. These illegal immigrants are housed in four star hotels, not five star, they are also provided with three meals a day, £40 a week spending money, free medical care and free dental care. Even should they lose their eventual asylum claim it's highly unlikely they will have to leave the country. None of these 'benefits' is available to them in France, could this answer my original question, why do they prefer England to France ?
