    Courier reporting hearts want to scrap promotion.

    What’s more unfair -

    a team winning the league by a country mile not being promoted

    a team that were poor all season and only won 4 matches out of 30 being relegated

    ????

    I don’t think any judge is going to think hearts are right on this.

    Hearts and Partick Thistle could be hammered by the SFA after holding a £10million gun to the heads of the rest of Scotland’s clubs.

    Record Sport understands compliance officer Clare Whyte is currently assessing if the M8 alliance has broken the articles of association by threatening to drag the SPFL into the Court of Session unless they are spared from relegation.

    Both clubs have lodged joint papers at Edinburgh’s Court of Session with Hearts demanding an £8m compensation package and Thistle looking for a £2m parachute payment if they are forced to drop down the divisions as a consequence of the coronavirus crisis.

    They are also threatening to take out an interdict to prevent the top flight from starting up on August 1 unless their demands are satisfied.

    The unprecedented move has provoked a furious response from clubs across the country and yesterday the top brass on Hampden’s sixth floor were busy examining their own rule book to establish if Hearts and Thistle should be dragged up on a charge.

    Under article 99 entitled ‘Resolution of Disputes between Members’ the SFA insist any such dispute should be brought before the governing body for arbitration rather than taken into the law courts.

    It is also made clear that any club wishing to raise a legal action at the Court of Session must ask for permission from the SFA before doing so.

    It reads: “A member, an associated person and/or the SFA shall not take a SFA Dispute to a court of law except with the prior approval of the Board.”

    Now Whyte could be set to wade into the civil war which has been ripping through the Scottish game since it was forced into lockdown in March.

    Under the rules, any breach of the articles of association is punishable by a raft of sanctions including ranging from fine up to ‘suspension’ and even ‘expulsion’.

    The rules state: “A recognised football body, club, official,Team Official or other member of Team Staff, player, referee or other person under the jurisdiction of the SFA if found to have infringed the Articles shall be liable to censure or to a fine or to a suspension or to an expulsion or to ejection from the Challenge Cup Competition, to any combination of these penalties or such other penalty, condition or sanction as the Judicial Panel considers appropriate.”

    Meanwhile, Record Sport understands back channel talks between outraged clubs continued yesterday in the wake of the legal move with the potential for a formal request for a vote on whether Hearts and Thistle should be expelled from the SPFL on the table.

    One Premiership club told us last night: “There are a lot of discussions going on behind the scenes and the anger is palpable.

    “I’ve never known so many clubs to be united by such a sense of fury.”

    Lots of clubs discussing suspending them both whilst court case goes ahead. Apparently even the newco are fed up (prob hence hearts not challenging titles won). Rules are clear on suspension and expulsion with court proceedings to protect all other members. Hearts apparently are angling for this but have underestimated their support - they wanted other clubs to resign.

    This isnt good news for scottish football though as any delay is a **** storm. Shame on them both its been about hearts all along. Shocking behaviour and to think i had empathy at first.

    Hearts have stooped to a new low and are now grasping at straws through their attempts to hold Scottish football to ransom. Initially I had some sympathy for them but not anymore. Ann budge has lost any respect that she has built up over the years by firstly Making a vailed attempt to bribe Scottish clubs and now this. They are a joke and the SFA need to come out fighting here and put them in there place. Partick are no better. Both need to be further penalised and a line drawn in the sand to deter any future chancers from trying their luck.

    Just a thought but are they ****ed financially? this seems like a play to the audience blame someone else game to me. US guy circles club - bet he knew but budge isnt prepared to show how bad. Aberdeen and Hibs in same boat. Big spenders without the revenue to substantiate it long term. Hamilton, St Js, Ross County - how the hell do they survive? Anyway i reckon they have just become a laughing stock. The comments from down south - fans who never really take interest in Scottish football are really interesting. To a person they say its a selfish act and they hope they both die now. Thats neutral fans (ok some of them are daily mail readers lol).

    We received a letter saying they were going to court to block our promotion. So its hearts and Thistle vc spfl, utd, raith and cove. Surely utd, raith and cove are innocents in this? Thats gonna get laughed out of court. Legal system is an arse so who knows what will happen but imagine they win we sue they appeal we appeal blah blah blah - no football till 2022?

    I've never had anything against Hearts. However, they have shown a complete lack of class here. This is the kind of nonsense I would expect from the Hunnage - but no from any other Scottish club.

    Deeply embarrassing behaviour from the Gorgie club.

    Bring on the court case, which will likely see them plunge themselves into administration.

    Make no mistake. We are going up. They are heading towards oblivion - and they chose to do it!! Muppetry of the highest order.

    Budge has certainly been shown up here with her initial portrayal of having the best interests of Scottish fitba at heart, but the longer this has gone on it’s obvious that’s not what her real intentions are.

    In saying this though, I firmly believe the powers that be have once again made a royal erse of things. It was clear from the outset that hearts, Raith and Stranraer would be majorly affected, and for me discussions regarding compensation should have been a priority.

    Isn't anyone else slightly concerned by this? I am, and clearly our club are, given it seems they've put our transfer business on hold until our status for season 20/21 is confirmed by the courts.
