He's sueing us for £45m because we beat them to the play-offs by overspending thus causing boro financial suffering even though there was no guarantees of them progressing past the first leg, surely any sane judge would throw it out at the first sight of their reasoning to bring a case

Boro are in financial trouble themselves apparently. That will be the driving force behind Gibbo's straw clutching. Didn't one of his companies buy (a part of?) Boro's debt a few years back? Is that within the EFL rules.

Wycombe got promoted through EFL "calculations". Might they be putting themselves open to the club they leapfrogged to promotion in an uncompleted season?

With regard to the background idea of any claim, what we have is one Limited Company that feels aggrieved by something they perceive another Limited Company has done. That means that Boro suing Derby for a possible loss is normal business practice.... or would be until you take the competition's rules into account. After much investigation, an appeal found that part of the DCFC accounting process "might have been explained better". That led to the resubmission of accounts and a marginal exceeding of FFP limits.

The EFL has hit DCFC as hard as it can. Gibson doesn't seem satisfied and is taking DCFC to court to solve his own club's financial mess. He can't hit us anymore via the EFL so the courts are his only redress. As others have said, any issues he still has should be taken up with the EFL as it is they who, aided and abetted by Covid, are responsible for the process taking as long as it did. Even a quick turnaround wouldn't have been in time to allow Boro to take our place in the playoffs...... his beef should be with them, not us.

    Gibbo would disagree.

What her any such claim would stand a cats chance in hell in the courts is a different issue. But I can't think of a reason why Gibson et al couldn't pursue a claim, however specious. I don't see how a case could stick, but....

It's all just trying to cash in on the situation by adding more complexities for the buyers
The only issue is that generally in sport, there are rules which each club signs up to and accepts as a member of the league and these rules normally prevent outside legal action but require disputes to go through the organisations dispute process. If thats the case then the claims will be thrown out at the first hurdle.

However, I remain convinced that its just a "fishing" expedition designed to muddy the waters for prospective buyers and along with HMRC could well be the reason its taking a while to resolve. Of course there are legal ways by which any claim can be excluded from a new ownership of the club, meaning they'd ahve to sue Morris. We shall see but don't expect anything to come of these.

John Percy (Telegraph) reporting that Mike Ashley is back in for Derby.
That is his ‘wait, see and bid late’ style.

To be honest I'd rather Ashley than Appleby who last time trickle fed the club 1m at a time each transfer window while Sam Rush was allegedly signing off ludicrous contracts, we'd end up with Nigel Clough again

Unfortunately its not in our hands and IF the media gossip is true his bid (if it exists) is far higher than Appleby consortium.

Whatever happens its going to be tough due to the level of debt.

Unfortunately it's upto the administrator to find the best outcome for the creditors and not who the best owner is for DCFC and if rumours are to be believed then a £50m offer from Ashley trumps a £30m offer from Appleby all day long, there may be other details that we won't be made aware of as well, think DCFC fans just want this whole saga to end whoever comes in
