By the very strict letter of the law it was a penalty because his arm made contact with the ball while in what could be described as an 'unnatural' position. Saying that, as penalties go you would struggle to find a softer one. It didn't look deliberate and it barely affected the flight of the ball. If it is deemed an offence in this case giving around an 80% chance of scoring when the actual chance was 1% is an incredibly harsh punishment.
