The players contracts were up, but the club had a option of a further 12 months on both players, Derby County
wanted to exercise the 12 month option on both players, but -
Both players exercised their rights Under the Transfer of Undertakings to leave the club, following the takeover.
Derby County were backed by the football league to extend Byrne's contract by the 12 months, but because the
club had been moved to a new company, following Clowes Development purchase it is governed by legalisation
known as the Transfer of Undertakings [Tupe].
While staff are automatically switched to the new company, employees have the right to under Tupe be told about
the transfer, & can object to the move, meaning they effectively resign.
Lee Buchanan did this & he moved to German club Werder Bremen, Derby County fighting for compensation, due
to the player being under 24 years of age.
Nathan Byrne moved to the USA & is playing for Charlotte FC.
