    Bolton Wanderers footballer Appears in Court, Accused of Assaulting a Doorman

    Bolton Wanderers 27 year old player Kyle Dempsey was in Carlisle Crown Court,
    after he & his father were accused of assaulting a doorman at a social club.
    The case adjourned until March 1st 2023, when pleas will be entered.

    Serious when a case goes to crown court.

    Actual bodily harm charge which had already been to magistrates Court and now passed on to Crown court

    Not a light sentence if found guilty:
    the maximum sentence is five years' custody. if the assault is racially or religiously aggravated, the maximum sentence is seven years' custody.

    The case of assault by Bolton Wanderers midfielder Kyle Dempsey, & his father Michael Dempsey on doorman
    Darryl Jarvis was heard today at Carlisle Crown Court.
    Kyle Dempsey told a court he is " embarressed ", after he " completely lost it " & attacked a social club doorman,
    the 27 year old has admitted assault following the incident.
    Kyle Dempsey's father Michael Dempsey a ex-professional rugby league player, also admitted assault.
    Carlisle Crown Court heard evidence ahead of sentencing on Wednesday, both Dempsey's admitted assaulting
    doorman Darryl Jarvis, causing actual bodily harm, having forced their way into the club, Michael Dempsey
    also admitted damaging a door.
    The prosecutor directed Kyle Dempsey to cctv footage, the prosecutor saying to Kyle Dempsey, " you've
    completely lost it there, haven't you ? ", Kyle Dempsey replied "Yeah".
    Footage showed Kyle Dempsey throwing punches & appearing to knee the doorman several times
    Darryl Jarvis the doorman said, he suffered a broken nose, chipped teeth, bruised ribs, heavy bleeding & a
    substantial cut to his head.

    Michael Dempsey said, he feared his son could suffer " serious damage " that " may finish his career ".

    Sentencing on Wednesday.

    Sentencing today on Kyle Dempsey & Michael Dempsey, at Carlisle Crown Court, for assault on doorman
    Darryl Jarvis.
    Footballer Kyle Dempsey was given a 12 month prison sentence, his father was given a 13 month prison
    sentence, in which both prison sentences both suspended 18 months, in the light of substantial mitigation,
    & a realistic prospect of rehabilitation.
    Both men were ordered to pay the doorman Darryl Jarvis £1,500 compensation, also complete 200 hours
    unpaid work, also night-time curfews, which can be varied in Kyle Dempsey case, in the light of any
    " employment issues ".
    The judge referred reference submitted to the footballers, attested charity work.
    Michael Dempsey must also complete rehabilitation work, & an alcohol abstinence monitoring requirement.
    It would seem Michael Dempsey got a extra 1 month, due to damaging a door.

    Substantial mitigation - Putting the facts to the judge, to get a lower sentence, loss of earnings
    if the player had got a prison sentence, even though the player & his father were guilty.

    Shouldn't the guilty think about this before they attack someone......always pleading for forgiveness after the fact...........no wonder we have crime rising with poor sentencing.....
