Thread: Barnsley FC Club Accounts 2022/ 2023

    It was mid July 2023 that we became aware of the EFL Investigation.

    As a reminder the EFL charges included--

    1. Barnsley FC have failed to provide the EFL with necessary notifications regarding the ownership position at the club

    2. Barnsley FC have failed to provide the EFL, despite requests from the EFL, with correct and complete information regarding the beneficial ownership of shares in the club.

    3. Barnsley FC have failed to publish accurate information publically regarding owners with significant interest

    4. Barnsley FC have allowed individuals to acquire a position of control without prior clearance from the EFL

    5. Barnsley FC have failed to act towards the EFL with the utmost good faith

    The above five charges relate to the club as a whole and, in addition--

    6. Barnsley FC Directors Paul Conway and Chein Lee are charged with causing the club to be in breach of EFL Regulations

    The Investigation has been going on seven months.

    That's a big list of transgressions SB. I'd say a points deduction could well be in the offing whether it be the end of this season or the start of the next.

    To be honest Pass I am not sure it is possible to forecast what the outcome might be, as to my knowledge there is no precedence been set before so predicting what punishment we may or may not get is guesswork & that is assuming we are guilty of every charge , you seem to think it could be a points deduction either at the end of this season or later , have you got some info as to what made you come to this conclusion / , incidentally it is a genuine question I ask because I simply have no idea one way or the other but if you have then please put me wise.,appreciated .

    I am hoping that Parekh is clever with this.

    He has already played the "We reported ourselves to you" card and the club may get some credit for that but it is a strategy used a lot nowadays by organisations/ businesses. Hopefully the EFL will become aware what a chancer Conway was and his responsibility for most of this non-disclosure. The question is will that matter to the EFL when it was and who was/were the key figure(s) as they might see it as "the club" overall being responsible as other Directors stood by watching this mess unfold.
    I am guessing that the Hedge Fund managers in Conway's Investor Group were the main individuals not disclosed and had no prior clearance by the EFL. They would not have much knowledge of English Football rules and protocols and left that stuff "in the safe hands" of Conway.

    As has been said there are few or no similar precedents so we can only guess what the punishment might be--
    --immediate docking of points
    --suspended docking of points depending on future behaviour
    --delayed docking of points to start of next season
    --financial penalty
    --complete dropping of all charges
    --removal of Conway and Lee as fit and proper persons to run a football club.

    My guess/ hope is a financial penalty and declaration of Conway and Lee as not fit and proper people to run a club. Something will happen. We will not get away scot free.

    I'm just guessing Shads. I find that usually by guessing a bad/worst case scenario, then it can't lead to disappointment. Not that I'm a glass half empty kind of blowk or owt!

    Im guessing the punishment will be served as a points deduction, just enough to allow Derby, or Bolton to regain their rightful place in the Championship, should a little club with less than 5k travelling away fans like us be successful in gaining promotion this season. .

    HMRC class any business with a turnover of less than £10.2 million as a "small business". Since our last Club Accounts showed a turnover of £9.5 million we are officially a "small club".
