Will he still be getting paid even though he's not doing the job he's employed to do? If he is getting paid then that will offset any fine he gets meaning (if, say, it was a week's wages) he's effectively just not being paid-which you wouldn't expect to be if you choose not to work.
Surely a fine, which is a punitive measure, should be on top of not getting paid?
