Flourbasher, that's a bit rich, four and a half million people have left Britain ,since the end of the second world war, and I was one of them, we leave our doors open, and keys in the car, because we are all law abiding Citizens. (Not) "Thanks for a good laugh."

I then batter the living s.hit out of him, though not killing him. I then phone the police. Will I be charged with assault bearing in mind this burglar's intent was to physically harm me?
How about you fear for yours and your family's welfare and beat him to death with your own baseball bat.... whether he's got one, he's not got one, or you're not sure what the hell he's got?

I'll tell you Brin because Kerr will say owt but admit he is wrong so at the risk of making Kerr's fantasies come true
You cannot use "grossly disproportionate" force
These are the words for some reason Kerr seems not to want to admit they exist

Which is the more grown up response:

    1. Kerr is correct in saying that a householder can use disproportionate force but perhaps he should have expanded that statement to point out that this does not include "grossly disproportionate" force

    2. Liar Liar pants on fire. Now say you're sorry.

That is exactly my point wrinkly as our resident legal expert is a stickler for being correct
Have you not read this thread?
Missing off "grossly disproportianate" changes the whole emphasis

I'm not too fussed about the omission tbh. I sort of guessed there would be a limit. Even though Kerr didn't specifically say so I didn't think, from what he wrote, that it would be ok for me to keep a burglar hostage for a couple of months and gouge out his eyes with a teaspoon.

You think the omission is very important - fair enough. I suspect you wouldn't have been as vehement if it had been another poster

Yes it would - at least for any other poster using every opportunity to continue a silly vendetta against someone.
