Could be. Police have to release or charge after 12 hours (or get extension if approved) and he was released just before his 12 hours were up pending further investigation. He can be arrested as often as the police want to for the same offence as long as it is for no more than 12 hours each time. Presumably they chose to arrest him so he could be questioned under caution but don't want to charge him yet until they have all of their ducks in a row. Of course he may never be charged
