In theory I don't see an issue with a VIP fast channel, it was unique circumstances needing fast action, there wasn't time to put out to tender etc. Even Starmer was behind methods to cut red tape.

The issue is it seems to have been clearly abused.

If the PPE she supplied wasn't fit for purpose then, IMO, she really should give the profits back AND what HMG paid for shoddy goods. Time of crisis or not, supplies should a) actually be supplied and it seems a lot wasn't and b) it should be up to the required standards and a lot wasn't.

The fast lane was illegal but put in place by HMG and I don't really think prosecuting Mone, the landlord et al would be morally correct.
Not supplying what you contracted to supply is probably both criminally and civilly illegal and could be acted upon.
Supplying goods not fit for purpose, idem ditto.

Why has no-one been taken to court over these apparent breaches of contract (fraud?) ?

If someone had got a fast track contract, supplied the goods they were contracted to supply and those goods were of the correct standard (or better) then I too see no issue with fast track.

It's the billions paid out to people who either didn't supply the goods (they still owe HMG/NHS the goods, then, don't they?) or supplied shoddy goods who need sorting.

For instance, if Mone (her husband) supplied shoddy goods then there is a case to answer. Profits back to HMG and likely the cost of the shoddy goods as well.

...and stripped of her OBE and life peerage on the grounds that she is unfit to be honoured or be involved in making decisions that impact upon the rest of us. I’m sorry if that sounds bitter but there are so many people doing genuinely good things for others in this world at a time when we all seem to be being dragged ever downwards by the greedy, avaricious and crooked b@stards in charge. (Rant over...for now!)

People are happy to take advantage, you only have to look at Captain Tom's family who have exploited what he did for personal gain.

Sale of goods act is pretty clear, if the goods are defective/not fit for purpose the buyer can apply to court for a full refund of amounts paid, plus reasonable expenses. I’ve claimed like this a few times before. However, there is a time limit on any claim, which on recent form is guaranteed to have been missed, either accidentally or otherwise, by HMG

Business to business sales contracts will generally exclude all of the implied terms under SOGA so the remedy is more like "merchantable quality" under contract law, and hence damages would apply.

Fair enough, I didn’t think HMG counted as a business

Customers must return faulty products within a reasonable time frame (usually three to four weeks) in order to claim a refund. The definition of reasonable time depends on the type of product and the nature of the fault.
