Dave Whelan has submitted a two-page document defending his position over the FA investigation into his alleged “racist” remarks.
The Football Association are now deciding “as a priority” whether to charge the Wigan chairman over the controversy.
Whelan sparked fury when, in a newspaper interview, he referred to Chinese people as “Chinks” and insisted Jewish people “love money”.
The Latics owner, 77, had been defending his decision to appoint Malky Mackay - also being investigated for alleged offensive text messages - as the club’s new manager.
The FA had given Whelan until 6pm Wednesday night to respond to their request for an explanation regarding his remarks.
Whelan in turn denied making racist remarks and claimed he would resign as chairman of Wigan if he is charged by the FA.
An FA statement said: “The FA will now consider Wigan Athletic chairman Dave Whelan’s observations in relation to his recent comments, having received them by today’s 6pm deadline.

Wigan chairman Dave Whelan has been charged by the Football Association with an aggravated breach of its rules following his comments about Jewish and Chinese people.
Whelan made the comments in an interview with The Guardian newspaper shortly after the 78-year-old appointed Malky Mackay as the Wigan’s new manager. Mackay is under investigation for sending racist and anti-Semitic text messages.
The FA wrote to Whelan to ask him for his observations on the comments he made which he submitted on Wednesday.
Sky Sports News HQ understands that Whelan had sent them a two-page submission. It is understood Whelan had said he felt obliged to support his manager and reiterated that he is not racist.
Since being told by the FA that he was being investigated, Whelan had threatened to resign as chairman of the Latics if found guilty of racism by English football’s governing body.
Despite having until Monday to decide whether to charge Whelan or drop its investigation, the FA has decided to ch
