Looked more like he shat himself and jumped out the way of a rash swipe at the ball. Not a dive for me, and I'm not sure if a swipe that makes no contact can be a penaly? If so, then I think it was a penalty.

I can see why you'd say that.. but on further investigation, apparently the guy had not long returned from a serious injury, so it's easy to see why he'd jump away like that from an outrageous swipe.
